Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. WAIVER OF OBSTETRICIAN REQUIREMENT INSOFAR AS IT PREVENTS DESIGNATION OF CERTAIN RURAL HOSPITALS AS DISPROPORTIONATE SHARE HOSPITALS. Section 1923(d)(2)(A) of the Social Security Act (42 U.S.C. 1396r- 4(d)(2)(A)) is amended-- (1) by striking ``or'' at the end of clause (i); (2) by striking the period at the end of clause (ii) and inserting ``; or''; and (3) by adding at the end the following new clause: ``(iii) which the State has designated as a critical access hospital (under section 1820(c)(2)) or as an essential rural health care provider (under applicable State law).''. <all>
